TERMS AND CONDITIONS – A-ledD INDIA REFERRAL PROGRAMME

1.  Programme Overview:

The A-ledD India Referral Programme ("Programme") is operated by AB Dating Services Limited, trading as A-ledD, registered at 71-75 Shelton Street, Covent Garden, London, Greater London, WC2H 9JQ, United Kingdom ("Company").

The Programme is intended solely as a marketing and promotional initiative and does not constitute a lottery, game of chance, gambling activity, employment relationship, agency arrangement, partnership, or contractual appointment of participants as representatives of the Company.

Participation in the Programme is free, and no purchase or payment is required to enter or participate.

 

2.  Eligibility:

Participation is open only to natural persons who:

(i) are resident in India;

(ii) are at least eighteen (18) years of age;

(iii) successfully complete any biometric facial age estimation and identity verification requirements imposed by the Company for receiving any referral rewards;

(iv) are not employees, contractors, agents, representatives, or immediate family members of the Company.

The Company may require documentary proof of age, identity, and residence before issuing any reward.

 

3.  Independent Participation:

Participants act solely as independent members of the public.

Participation in the Programme does not create any employment, agency, partnership, contractor, representative, fiduciary, or other legal relationship between the participant and the Company.

Participants shall not represent that they are authorised to act on behalf of the Company, negotiate contracts, bind the Company, or make commitments in the Company's name.

 

4.  Points System:

Points may be awarded in accordance with the rules published by the Company from time to time, including, for example:

(i) fifty (50) points for registering for the Programme;

(ii) five (5) points for following an official A-ledD social media channel (Facebook, Instagram, Threads, X).  These are subject to change at any time;

(iii) thirty (30) points for each accepted qualifying referral.

The Company reserves the right to amend the points system at any time without notice, verify all activities and to refuse, adjust, or remove points where fraud, abuse, manipulation, duplicate accounts, or other improper conduct is suspected.

5.  Fraud Prevention:

To ensure fairness and a level playing field for all participants, all referrals will undergo an automated validation process.

The Company may utilise third-party fraud prevention and verification providers to detect duplicate accounts, artificial referrals, automated activity, or other conduct inconsistent with the purposes of the Programme.

Participants engaging in fraudulent, misleading, deceptive, abusive, or unauthorised conduct may be disqualified without notice and may forfeit any entitlement to rewards.

Please note:  Referral points will not be credited, and referrals will be deemed invalid, if the referred user registers using the same Wi-Fi network, the same IP address, or the same physical device as the referrer.  Furthermore, any attempts to manipulate the leaderboard via fraudulent or artificial means—including, but not limited to, the use of VPNs, proxy servers, temporary/disposable email addresses, emulators, simulated environments, or bot networks—are strictly prohibited.  This is a non-exhaustive list, and the Company reserves the sole and absolute right to investigate any suspicious activity, disqualify any participant, and forfeit entries for any behaviour deemed to manipulate the spirit of the rewards programme.

 

6.  Rewards:

At the conclusion of the applicable referral period, the top referrer(s) with the highest verified points total shall receive a digital gift card with a value to be confirmed for each referral reward period.

Rewards shall be issued through a third-party gift card provider selected by the Company.

Rewards are non-transferable, non-exchangeable, and cannot be redeemed for cash unless required by applicable law.

The referrer will be contacted via the sign-up email address by the company in order for the referrer to receive the reward.

 

Specific reward values for each period will be published via official campaign communications (such as via the relevant referral period email) at the start of that respective period.

The Company reserves the right to substitute a reward for one of equal value—for example, replacing a specified gift card with an alternative brand of the same value.

 

7.  Tie-Break Procedure:

Where two or more participants finish the relevant referral period with identical referral points totals, the tie shall be broken based on the timestamp of the referrer’s initial registration for the campaign.  The referrer with the earliest registration timestamp shall be awarded the higher position on the leaderboard and earn the corresponding reward.

Notwithstanding the above, the Company reserves the right, at its sole discretion, to reward equally placed tied participants with the same reward amount, which shall equal the maximum reward value allocated for that specific leaderboard tier.

 

8.  Age and Identity Verification:

The Company may require participants who have been awarded a referrer reward to complete a biometric facial age verification through a third-party verification provider selected by the Company.

Failure to complete verification requirements within the timeframe specified by the Company may result in forfeiture of any reward.

 

The Company will contact reward winners via their registered email address.  Winners must complete the required age verification and claim their reward within thirty (30) calendar days of the initial notification email.  Failure to do so will result in the total forfeiture of the reward, and the Company may, at its sole discretion, award it to the next eligible participant on the leaderboard.

 

9.  Data Protection and Retention:

The Company shall process all personal data in accordance with its Privacy Policy, the UK GDPR, and the Indian Digital Personal Data Protection (DPDP) Act.  Personal information including a biometric facial age estimation check uploaded for age verification for individuals receiving rewards will be shared with our third-party age verification provider, Didit, solely for the purpose of validating eligibility.  If an individual does not pass the biometric facial age estimation check, then that individual will be required to upload government-issued identification in order to prove they are over 18 years of age.

When you sign up to the A-ledD India Referral Programme, we ask for certain information about you so that you can join the programme. The information you provide is based on your consent, especially for sensitive information, known as “special categories of data”.  We do not collect data about you from other sources.  Typically, personal data elements we collect as part of you joining the referral programme include:

 

  • Country.

  • City.

  • Time zone and Time zone offset.

  • IP address.

  • Timestamp of sign-up.

  • Email address.

  • Mobile phone number.

  • Confirmation that the user is over 18 years of age via a 3rd party biometric facial age estimation checker (only for referrers who receive a reward).

  • Government-issued identification documentation (e.g., Passport, Driving Licence, or National ID).  This is only required for referrers who receive a reward and fail the initial biometric facial age estimation check.

  • Communications that you may have with us – for example with our helpdesk

  • Details regarding your device (Brand, browser, model, Operating System (OS), platform) (only for referrers who receive a reward).

  • VPN / Data centre flag (only for referrers who receive a reward).

10.  Taxes:

Participants are solely responsible for determining and satisfying any tax obligations arising from their participation in the Programme or receipt of any rewards.

​The Company reserves the right to comply with any legal or regulatory obligations relating to tax reporting, withholding, or disclosure where required by applicable law.

11.  Modification and Termination:

The Company reserves the right to amend, suspend, or terminate the Programme at any time, without any notice, where reasonably necessary for operational, legal, technical, or commercial reasons.

 

12.  Limitation of Liability:

To the maximum extent permitted by law, the Company, its directors, and employees shall not be liable for any indirect, incidental, or consequential damages arising out of participation in the Programme.  The Company accepts no responsibility for any technical malfunctions, network failures, or delivery issues related to third-party gift card providers or verification services.

 

13.  Governing Law:

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, except to the extent that mandatory provisions of applicable Indian law may apply to participants resident in India.

The courts of England and Wales shall have exclusive jurisdiction over disputes arising in connection with the Programme, subject to any mandatory rights that cannot lawfully be excluded.
